RECOMMENDATION(S):

APPROVE and AUTHORIZE the Department of Conservation and Development Director, or her designee, to execute a contract amendment with Entrix, Inc. to extend the term from April 16, 2009 to April 30, 2010, with no change to the payment limit of $359,898, for providing environmental consultant services for the Air Products and Chemicals Environmental Impact Report.

FISCAL IMPACT:

None. The cost is covered by revenue received from the applicant, Air Products and Chemicals.

BACKGROUND:

The Air Products gas fuel pipeline project is located within a portion of the unincorporated Martinez area of Contra Costa County and the City of Martinez. The two underground pipelines are proposed to travel westbound 2.6 miles in an area along Waterfront Road from the Golden Eagle Refinery to connect with the existing Air Products Hydrogen Plant at the Shell Refinery in Martinez.

To assist staff in preparation of an Environmental Impact Report (EIR), the County entered into a contract with Entrix, Inc. an environmental consultant. The EIR prepared for the Air Products pipeline is at the second administrative draft review stage. A draft EIR (DEIR) and response to comments to the DEIR is still needed to complete the environmental analysis for the Air Products and Chemicals pipeline project. Staff recommends that the Board approve and authorize an extension of this contract to April 30, 2010.
