RECOMMENDATION(S):

APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute a Grant Deed (two parcels) and a Grant of Easement on behalf of Contra Costa County Flood Control and Water Conservation District (District) to the City of Brentwood (City) for property rights needed by the City in connection with Subdivision 8954 (Prewett Ranch).  
  

DIRECT the Real Property Division to cause said Grant Deed and Grant of Easement to be delivered to the City for recording.  

  




RECOMMENDATION(S): (CONT'D)
ACCEPT the Grant of Easement dated March 11, 2009 from the City to provide the District with creek access within said subdivision.   
  
DIRECT the Real Property Division to have said Grant of Easement recorded in the Office of the County Recorder.   

FISCAL IMPACT:

The aggregate funds received of $39,000 have been deposited into Flood Control Zone 1.

BACKGROUND:

The District acquired certain real property, referenced in said documents for flood control purposes and has been determined to be surplus and no longer necessary for District purposes and their individual values do not exceed $25,000.  
  
These property rights that are to be conveyed to the City in connection with said subdivision are required for the extension of Adams Lane and the need for a waterline easement.  
  
An easement to the District in connection with said subdivision is required to provide access (Drainage Area 30C, Lines A and B) to the District for flood control maintenance in accordance with approved plans and specifications.  
  
The Contra Costa County Board of Supervisors adopted the previously adopted City of Brentwood Prewett Ranch Mitigated Negative Declaration on April 25, 2006.  

CONSEQUENCE OF NEGATIVE ACTION:

The District will be responsible for the liability and maintenance of certain portions of Adams Lane and the waterline easement that has already been constructed. Also, the District will not have sufficient land rights for flood control access in accordance with approved plans and specifications.
