RECOMMENDATION(S):

ADOPT Resolution No. 2009/129 approving the Second Extension of the Subdivision Improvement Agreement (Right-of-Way Landscaping), for Road Acceptance 04-01166 (cross-reference Subdivision 03-08509), for project being developed by Windemere BLC Land Company, LLC, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District III)

FISCAL IMPACT:

None.

BACKGROUND:

The landscape improvements known as Phase 4 Trails have not been fully completed. The Subdivision Improvement Agreement (Right-of-Way Landscaping) needs to be renewed.

CONSEQUENCE OF NEGATIVE ACTION:

The agreement will not be renewed.
