RECOMMENDATION(S):

RECEIVE this report concerning the final settlement of Tiffany Duque and authorize payment from the Medical Liability Internal Service Fund in the amount of $350,000.

FISCAL IMPACT:

Medical Liability Internal Service Fund payment of $350,000.

BACKGROUND:

Attorney W. David Walker, defense counsel for the County, has advised the County Administrator that within authorization an agreement has been reached settling the medical malpractice claim of Tiffany Duque v. County of Contra Costa.

The Board's March 17, 2009 closed session vote was Supervisors Gioia, Uilkema, Bonilla and Glover - Yes; Supervisor Piepho - Absent.

This action is taken so that terms of this final settlement and the earlier March 17, 2009 closed session vote of this Board authorizing its negotiated settlement are known publicly.
