RECOMMENDATION(S):

1. APPROVE a First Amendment to Lease with 230 Alamo Plaza, LLC, commencing January 1, 2012, and ending December 31, 2014, for 3,000 square feet of office space at 150 Alamo Plaza, Suites B & C, Alamo, at a monthly rent of $6,750, for continued occupancy by the Sheriff-Coroner, under the terms and conditions set forth in the First Amendment to Lease.  
  

2. AUTHORIZE the Director of Public Works, or designee, to EXECUTE the First Amendment to Lease.

3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#11-73; WLP722)  
  
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of Public Works, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.  

FISCAL IMPACT:

This First Amendment to Lease will obligate the County to pay an initial monthly rent of $6,750, and a total rent of approximately $250,320 over a 3-year period. When additional monthly expenses of $1.10 per square foot for common area maintenance, utilities, and janitorial expenses are added to the total rent, the total cost for the First Amendment to Lease is approximately $10,050 per month, and approximately $369,120 over the remaining term of the Lease. (100% General Fund)

BACKGROUND:

The Sheriff-Coroner has occupied this location since February 1996 as a substation for its patrol activities in the south central area of the county. Approving the First Amendment to Lease will provide for the Sheriff-Coroner’s continued occupancy of this location to support law enforcement activities and services to residents in the Alamo area.

CONSEQUENCE OF NEGATIVE ACTION:

If the First Amendment to Lease is not approved, the Sheriff-Coroner will either not have a substation in the south central area of the county to provide law enforcement services to residents of this area, or will have to find another location for its substation at an additional cost.
