RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to sign and submit a Cooperative Work Agreement (CWA) extension request to California Department of Transportation (Caltrans) and California Department of Finance to extend the use of federal funds allocated to Iron Horse Trail Pedestrian Overcrossing Project to June 30, 2013.

FISCAL IMPACT:

Contra Costa County was awarded federal funding for the Iron Horse Trail Pedestrian Overcrossing Project. In 2001, a portion of these funds were allocated for expenditure with a reversion date of June 30, 2012, after which, the unspent balance of allocated funds would be lost. This Cooperative Work Agreement request, subject to final approval by the California State Department of Finance, extends the deadline for using the unspent fund balance for up to one year.

BACKGROUND:

On June 10, 2003, the Board approved the design of the pedestrian overcrossing at Treat Boulevard. This project provides for pedestrian and bicycle safety when crossing the heavily trafficked Treat Boulevard. The bridge will also link discontinuous sections of the Iron Horse Trail. The Preliminary Engineering phase of the Iron Horse Trail Pedestrian Project was awarded with federal funds. Approximately $33,000 of these funds, which are currently available for expenditure, will expire on June 30, 2012 unless a CWA is put into place to extend the expenditure deadline for up to one year. These funds will be needed beyond the June 30, 2012 deadline in order to shift the Preliminary Engineering phase funds to the Construction phase. The funds cannot be shifted until the final construction invoice to Caltrans, which is being delayed due to a lighting issue. In order to ensure that funds are available to complete the funding shift, the Public Works Department recommends requesting this one-year funding extension.

CONSEQUENCE OF NEGATIVE ACTION:

An extension request for the funds awarded for the Iron Horse Trail Pedestrian Overcrossing Project will not be signed and submitted, and those funds will not be available for the funding shift from the Preliminary Engineering phase to the Construction phase of the project unless the project is closed out by June 30, 2012.

CHILDREN'S IMPACT STATEMENT:

None.
