RECOMMENDATION(S):

APPROVE the Right of Way Contract and ACCEPT Grant Deed dated September 28, 2011 from Pacific Western Conference of the International Pentecostal Holiness Church, Inc. (Church); AUTHORIZE the Public Works Director, or designee, to execute the Right of Way Contract on behalf of Contra Costa County (County) for the required property rights located at 11 Texas Street, Antioch, a portion of Assessor Parcel Number (APN) 067-283-017.


APPROVE the conveyance of portions of County owned property located at 10, 16, 20 and 22 Drake Street, Antioch, identified as portions of APN 067-283-016, 067-283-015, 067-283-008, 067-283-009 pursuant to Streets and Highway Code Section 960 and AUTHORIZE the Chair, Board of Supervisors, to execute the Grant Deed on behalf of the County.

APPROVE payment of $319,000 for the property rights payable by the Contra Costa Transportation Authority (CCTA) to Fidelity National Title Company, Receiving Bank: Bank of America, 275 Valencia Blvd, 2nd Floor, Brea, CA 92823-6340; ABA Routing No.: 026009593; Credit Account Name: Fidelity National Title Company – Danville, 501 Sycamore Valley Road West, Danville, CA 94526; Credit Account No. 12352-64125; Escrow No.: 10-334770-DH; Attention: Debbie Heiden, (925) 831-9300 Ext 212.

DIRECT the Real Property Division to have the above referenced Grant Deeds delivered to Fidelity National Title Company for recording in the Office of the County Recorder.

FISCAL IMPACT:

The activity is funded by CCTA (100%).

BACKGROUND:

The property rights are required for the State Route 4 (E) Widening - Somersville Road to Route 160 Project in accordance with the approved plans and specifications which will impact a number of parking spaces as required by the City of Antioch for Church functions. The conveyance of a portion of the County owned parcels adjacent to the Church property will mitigate the loss of the parking spaces and severance damages. SCH No. 2004092135

CONSEQUENCE OF NEGATIVE ACTION:

The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
