RECOMMENDATION(S):

APPROVE AND AUTHORIZE the County Clerk-Recorder, or designee, to execute a contract amendment with Election Systems & Software, Inc. (ES&S), effective November 4, 2009, to increase the payment limit by $61,918 to a new payment limit not to exceed $13,499,598 to upgrade the vote tabulation system to California 3.0.1.1, with no change to the original contract term of February 15, 2005 through December 31, 2010.

FISCAL IMPACT:

The cost of the parts and services needed to install the upgrade is $61,918. Hardware and firmware licenses, maintenance and support is covered by the original contract through December 31, 2010.

Contra Costa is eligible for grant funding through the Federal Help America Vote Act (HAVA). The grant funding is secured through a state contract executed in 2008 with an expiration date of December 31, 2010, at which time Contra Costa's unspent allocation will revert back to the state.

BACKGROUND:

The upgrade will allow Contra Costa to utilize certified improvements made to the system since the original purchase in 2005.

CONSEQUENCE OF NEGATIVE ACTION:

Failure to purchase the parts and service needed to install this upgrade will prevent Contra Costa from taking advantage of improvements to the election tabulation system firmware, software and equipment prior to the 2010 state and local elections. If the purchase is not made and reimbursement requested before December 31, 2010, Contra Costa will lose the ability to pay for this upgrade with Federal funding. Future purchase of the upgrade will require the expenditure of General Fund monies.
