RECOMMENDATION(S):

RESCIND Traffic Resolution 2004/4066, and ADOPT Traffic Resolution No. 2009/4303 establishing speed limits on Camino Diablo (Road No. 7941), as recommended by the Public Works Director, Brentwood/Byron area.

FISCAL IMPACT:

There is no fiscal impact to the general fund.

BACKGROUND:

This action will enable law enforcement to enforce the following speed limits, on the basis of an engineering and trafiic survey:

* 50 miles per hour beginning at the intersection of Marsh Creek Road and extending easterly to a point 0.25 miles west of Holway Drive  
  
* 35 miles per hour, from a point 0.25 miles west of Holway Driveand extending easterly to the intersection of Byron Highway

CONSEQUENCE OF NEGATIVE ACTION:

Unable to use local authorities' powers to enforce the California Vehicle Code.
