RECOMMENDATION(S):

CONSENT to joint representation of County and the Housing Authority of the City of Richmond by Goldfarb & Lipman on matters relating to the Maritime Day Care Center located on Florida Avenue in Richmond; and APPROVE and AUTHORIZE the County Counsel, or designee, to execute the attached consent of potential conflict of interest.

BACKGROUND:

Over the years, the County of Contra Costa (“County”) has entered into contracts with Goldfarb & Lipman for consulting services in connection with the CDBG, HOME and HOPWA programs. Because Goldfarb & Lipman’s concentration of work is in affordable housing and redevelopment, it is not uncommon for the firm to have an attorney-client relationship with more than one party to a complicated redevelopment or housing transaction.

The County has leased the Maritime Day Care Center (“Center”) to the Rosie the Riveter Trust (“Trust”). As part of a proposed redevelopment of the nearby Nystrom Village public housing project, the Housing Authority of the City of Richmond (“RHA”) intends to assist the Trust in rehabilitating the Center and incorporating it in to a larger redevelopment effort. RHA has requested that Goldfarb & Lipman represent it in connection with the project. While no conflict currently exists, Goldfarb & Lipman has an ongoing attorney/client relationship with RHA and the County. Attached is a letter from Goldfarb & Lipman describing the project in which the law firm will be assisting RHA, disclosing the existing attorney-client relationship, and requesting the County’s acknowledgment and consent.
