FISCAL IMPACT:
This project is funded by 79% Active Transportation Program (ATP) Federal Grant Funding, 8% Navy Mitigation, 8% Measure J, 4% Bay Point Area of Benefit (AOB), and 1% Gas Tax.
BACKGROUND:
The Contra Costa County (County) Public Works Department is required to obtain an Encroachment Permit from Caltrans for the Bailey Road/State Route 4 Interchange Pedestrian and Bicycle Improvement Project (Project) in order to perform survey work and collect topographic data within Caltrans right of way along the State Route 4 on and off ramps at the Bailey Road interchange in Bay Point. This survey data is required to complete design of the Project.
Under the permit, the County must indemnify and hold harmless the State, its officers, directors, agents, and employees (Indemnitees) from and against any and all claims that arise from the work covered by the permit, unless the claim arises from the sole negligence or willful misconduct of the Indemnitees.
CONSEQUENCE OF NEGATIVE ACTION:
The County would be unable to perform survey work and collect topographic data within Caltrans right of way and complete design of the Project.
