RECOMMENDATION(S):

  1. APPROVE a Lease with the Sand Creek Business Center 1, Limited Partnership, commencing May 15, 2009, and ending May 14, 2011, for approximately 1,177 square feet of office space at 181 Sand Creek Road, Building 3, Unit L, Brentwood, at a monthly rent of $2,000 for occupancy by the District 3 Supervisor, under the terms and conditions set forth in the Lease.

  2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease.

  3. DETERMINE that the project is a Class 1, Section 15301 Categorical Exemption under the California Environmental Quality Act (CP #09-22).

  1. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.

FISCAL IMPACT:

Approval of the Lease will obligate the County to pay approximately $56,640 in rent for the two-year lease term, which includes maintenance services. This expense was budgeted in the approved FY 2008-2009 and FY 2009-2010 budget. Custodial services will be supplied by the landlord.

BACKGROUND:

Approval of the Lease will provide office space for the District 3 Supervisor for the next two years. The current District 3 Brentwood office was leased in April 2003 and expired in October 2008. The lease has been on a month-to-month holdover while other office locations were evaluated. The current space lacks a private conference room, storage and copier space, and kitchenette. The new office provides the needed conference room, copier/break/storage room, and in-suite restroom facilities for the same rent as the current space.

CONSEQUENCE OF NEGATIVE ACTION:

Failure to approve the Lease will require seeking another office space location or staying in the current leased space, which is inadequate to meet the operational needs of the District 3 Supervisor.
