RECOMMENDATION(S):

ADOPT Resolution No. 2009/201 amending Subdivision Agreement (Right-of-Way Landscaping), for SD 99-08381, for project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp., as recommended by the Public Works Director, Danville area. (District III)

FISCAL IMPACT:

None.

BACKGROUND:

The developer has partially completed the required landscape improvements and requested a reduction of the bonding obligation proportionate to the remaining work.

CONSEQUENCE OF NEGATIVE ACTION:

The performance surety bond obligation will not be reduced.
