RECOMMENDATION(S):

APPROVE and AUTHORIZE the conveyance of interest in real property to Ronald E. Nunn, et al, and AUTHORIZE the Chair, Board of Supervisors, to execute a Grant of Access Right on behalf of the County, as recommended by the Public Works Director, Brentwood area.

FISCAL IMPACT:

There is no impact to the County General Fund.

BACKGROUND:

On April 6, 2009, the State Route 4 Bypass Authority (Authority) and Ronald E. Nunn, Shirley A. Nunn, Jeffrey Tamayo, and Sara L. Tamayo (Property Owners) entered into a Driveway Agreement and approved the relinquishment of access rights for the relocation of the Property Owners’ existing driveway over a portion of their property identified as Assessor’s Parcel No. 007-150-017. A condition of the agreement requires the Property Owners to relinquish to the Authority their existing access rights to Vasco Road, at the location of their existing driveway, and to seek a new grant of access rights to Vasco Road from the County for the relocated driveway.

The Property Owners have executed a Relinquishment of Access Rights as required under the agreement and have requested that the County execute a Grant of Access Rights, attached hereto at the location of the relocated driveway.   
  
It has been determined that the access rights sought by the Property Owners in this matter, and described in Exhibit A to the attached Grant of Access Rights, will not interfere with County or other public purposes.

CONSEQUENCE OF NEGATIVE ACTION:

Property Owners will not obtain the rights necessary to access their property.
