RECOMMENDATION(S):

APPROVE and AUTHORIZE the Director of the Department of Conservation and Development, or designee, to execute a contract amendment with Mills and Associates (Contractor) extending the contract term to December 31, 2009 to allow Contractor to continue to provide CEQA preparation services for the Coronado Estates and Commercial Development, Hotchkiss Tract, with no change to the payment limit of $44, 214.

FISCAL IMPACT:

None. The cost is covered by revenue received from fees paid by the project applicant.


BACKGROUND:

The proposal is for construction of a 185-unit residential project, golf course and clubhouse and an approximately 105,000 square feet retail center referred to as Coronado Estates by the developer. The Coronado Estates project is located to the east and north of the City of Oakley on Bethel Island Road. The applicant has provided detailed site plans and information as well as several professional environmental studies. The particular consultant's expertise along with specialized sub-consultants is needed in order to prepare the environmental assessment required by the California Environmental Quality Act (CEQA).  
  
The County has set up an account specific to expenses that the County and the consultant encumber in the review of submittals from Sosnowski and Associates for this project. The applicant has provided funds to cover the agreed upon cost of the consultant in addition to a surcharge to cover the cost of contract administration.  
  
The amendment will allow the Contractor to continue to provide the necessary service.
