RECOMMENDATION(S):

PROVIDE a one-time lump sum ratification payment of $750 to Lynne Simoncini-Sarmiento (represented).

FISCAL IMPACT:

The cost of the lump sum ratification payment is projected to be approximately $750 (one-time).

BACKGROUND:

Lynne Simoncini-Sarmiento (Employee # 71715) worked for many years as a Senior Level Clerk represented by AFSCME Local 2700. On April 15, 2014 she transferred to the position of Panel Nurse represented by Local One. As a longtime full-time permanent employee, she would have been entitled to receive a lump sum payment from Local 2700 if she had not been promoted. However, due to her window of promotion she missed both of the lump sum payments made to members of Local 2700 and Local One.  




BACKGROUND: (CONT'D)
  
Per section 5.1.A.4.a. of the 2700 MOU to receive the August 8, 2014 lump - the employee must be employed by the County in a classification represented by the Union on July 1, 2014. Ms. Sarmiento was not represented by Local 2700 on August 8, 2014.

  
Per section 5.1.C.1.a. of the Local 1 MOU to receive the May 10, 2014 payment - the employee must be employed by the County in a classification represented by the Union on the first day of the month in which the MOU is adopted by the Board of Supervisors. The MOU was adopted on April 22, 2014, which means Ms. Sarminto would have had to be in Local 1 on April 1, 2014.   
  
Although under the terms of the MOUs this employee is not entitled to a 2014 lump sum ratification payment, due to her longtime employment with the County, the County Administrator is recommending that an exception be made. Similar exceptions have been made for three employees who were promoted into Local 21 classifications on April 15, 2014.  

CONSEQUENCE OF NEGATIVE ACTION:

This longtime County employee would not receive the lump sum payment her co-workers received due to her transfer date from Local 2700 to Local One.
