RECOMMENDATION(S):

APPROVE Appropriations and Revenue Adjustment No. 5021 authorizing new revenue in the amount of $26,977,815 for criminal justice programs from the State of California under AB 109 public safety realignment and appropriating it to various budget units within new Fund 115300 - County Local Revenue Fund 2011, as required by AB 118, for expenditure in the current fiscal year.  

FISCAL IMPACT:

No direct impact to the County General Fund, as the new revenue and expenditure appropriations are accounted for in a separate fund as required by statute.  

BACKGROUND:

As part of the 2011/12 budget plan, the State Legislature enacted a major shift or "realignment" of state program responsibilities and revenues to local governments. The criminal justice or “Phase I” portion of 2011 realignment results in the following new responsibilities for counties:  

  • Incarceration of lower-level offenders (specified non-violent, non-serious, non-sex offenders) in local county jail and an expanded role for post-release supervision for these offenders;
  • Post-release supervision of lower-level offenders (those released from prison after having served a sentence for a non-violent, non-serious, and non-sex offense) by creating a new category of supervision called Post-Release Community Supervision (PRCS);
  • Housing responsibility for parole and PRCS revocations in local jail custody
While there is a promise of funding beyond FY 2011/12, there is no guarantee. Counties are actively seeking a constitutional amendment to secure a guarantee of continued funding to support the shifted responsibilities.  
  
Assembly Bill 118 prescribes how counties must receive and account for revenues transferred under 2011 realignment. The legislation requires establishment of a County Local Revenue Fund 2011 and myriad sub-accounts that must be tracked and reported to the state at a future date. Approval of the attached adjustments will appropriate an estimated $27 million in realignment revenue to support existing and newly realigned programs, including the Community Corrections Plan adopted by the Board on October 4, 2011.  
  
  
  

CONSEQUENCE OF NEGATIVE ACTION:

If the adjustments are not approved, the Sheriff, Probation, Health Services, District Attorney, and Public Defender departments will not be able to obtain the necessary resources to comply with new program mandates and the County will be out of compliance with the requirements of AB 109 and AB 118.
