RECOMMENDATION(S):

ADOPT Resolution No. 2011/459 accepting completion of private improvements per the Road Improvement Agreement for Weatherly Lane (cross-reference subdivision SD 89-07418), for a project being developed by First National Bank of Northern California, Martinez area. (District V)

FISCAL IMPACT:

No fiscal impact to County Funds. The funds to be released are developer fees that have been held on deposit pending completion of the warranty period.

BACKGROUND:

The developer has completed the curb and gutter repairs required by the Road Improvement Agreement, and the settlement agreement with First National Bank of Northern California.

CONSEQUENCE OF NEGATIVE ACTION:

The completion of private improvements will not be accepted and the Road Improvement Agreement will not be exonerated.
