BACKGROUND:
The termination date of the Subdivision Agreement needs to be extended. The developer has not completed the required improvements and has requested more time. (Approximately 38% of the work has been completed to date.) By granting an extension, the County will give the developer more time to complete improvements and keep the bond current.
CONSEQUENCE OF NEGATIVE ACTION:
The termination date of the Subdivision Agreement will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed, or revert the development to acreage.
